TERMS AND CONDITIONS
In the following terms and conditions, “our website”, “we” and “us” refer specifically to www.hideawayportugal.com, and Alexander Corrie Ltd. “Owners” refers to owners, managers or other individuals who list holiday homes and related services on our website. “Travellers” refers to all viewers and users of our website. “Holiday homes” relates to properties which are rented out on a temporary basis, for a specific time period and price agreed between Owners and Travellers. “Related Services” includes any services, such as (but not limited to) catering, guiding and specialized courses.
By using www.hideawayportugal.com, Owners and Travellers agree to all terms and conditions on our website. Owners and Travellers who do not agree with all our terms and conditions should not register on or use our website.
THE NATURE OF OUR BUSINESS
We are a venue where Owners advertise holiday homes and related services and Travellers enquire, book, make payments to and agree with conditions directly with Owners.
WE DO NOT REPRESENT OWNERS OR THEIR HOLIDAY HOMES OR RELATED SERVICES
We do not represent or manage Owners, their holiday homes or related services, nor do we manage their bookings. We provide Owners with an individual Owner account, with tools and sections to accurately advertise their holiday home and related services.
AGREEMENTS BETWEEN OWNERS AND TRAVELLERS
Owners and Travellers come to agreements between themselves. We are not responsible or liable for any agreements, payments, misunderstandings or legal cases between Owners and Travellers.
OWNER REGISTRATIONS AND ADVERTISING SUBSCRIPTIONS
We offer Owners the tools and space to advertise their property and related services for a limited time period on our website, as contracted at the time of registration and /or payment. At the end of this time period (usually, but not limited to one year), the advertising subscription terminates. Unless a renewal or further agreement or payment takes place, we deactivate the advert from our website. When agreed between Owners and us, we may also separately charge fees to Owners for related services, such as (but not limited to) translation, photography and consulting. We cannot provide compensation for any period of time during the annual subscription in which the website or a specific webpage may become unavailable. We reserve the right to deactivate any Owner account, when the Owner using that account has broken any terms or conditions of our website, or as a result of, but not limited to posting of inappropriate information, infringement of copyright, giving false details, using our website for commercial purposes or acting in any other inappropriate or damaging way.
We allow Travellers to register for free on our website, in order to use the features given within the traveller account. However, we reserve the right to deactivate any traveller account, when the Traveller using that account has broken any terms or conditions of our website, or as a result of, but not limited to posting of inappropriate information, infringement of copyright, giving false details, using our website for commercial purposes or acting in any other inappropriate or damaging way.
When Owners and Travellers register on or use our website, they agree for us to store any information they have sent us, such as contact details and passwords, in our databases. They agree that we may use contact details as a way of contacting them or of sending promotional material, such as occasional newsletters, which can be opted out of when received. They also understand and agree that we use information given by our registered users for our own internal analysis, such as but not limited to demographic trends of our users, for us to better understand our clients. We do not share Owner or Traveller information with third parties.
We cannot assume any responsibility for the stated identity of Travellers who contact Owners. If Owners wish to receive confirmation of the identity of Travellers, then they must do so themselves. As examples, Owners could ask for passport photocopies from Travellers when booking. It is up to Owners to decide on who they are willing to accept at their holiday home.
PASSWORDS AND SECURITY QUESTIONS
Owners and Travellers are responsible for keeping their passwords and security questions secure and confidential. If you believe that other people may have received your passwords and security questions, or entered your account, you must notify us immediately in writing. You must also notify us immediately if you believe anybody has asked for or tried to obtain your password and security information, such as by sending you an email to verify them. Apart from other people you trust who you may have authorized to access your account in order to help you update information, we discourage you from sharing or sending your password and security questions to anyone. Although no financial information is stored within registered accounts, people who enter your account could, for example, alter details about your property or post material under your name. We also urge you to change your password and security answers from time to time and to think of passwords and security answers which are not easy, obvious or connected with other websites that you use. We cannot be held responsible for any breach of your account which has taken place before you have notified us in writing. We may temporarily inactivate your account if we believe it has been breached, even if we have not received notification from you. If you forget your password, please click on the Forgot Password link to reset it. If you forget your security answers, please contact us.
When Owners and Travellers post information and photographs on our website, they grant us an unrestricted, perpetual, worldwide, irrevocable, non-exclusive, royalty-free and fully paid-up license for using, copying, distributing, displaying and editing said photographs and information. We require these rights in order to display your opinions, information and photographs on our website. We cannot be held liable at any time by Owners and Travellers for infringement of copyright Owners and Travellers must also be aware that other users of our website will be able to access and copy this information and that links, information and photographs will become part of the world wide web, meaning that we will have no control over its appearance and distribution.
USE OF THIRD PARTY COPYRIGHTED MATERIAL
Owners and Travellers may not use material (such as photographs) on our website which belongs to and has been copyrighted to third parties, unless permission has been granted. Material which infringes on the copyright of others will be removed from our website, once we have been made aware of the situation. It may also lead to the delisting of a property page, Owner or Traveller.
LINKS TO OTHER WEBSITES
Owners and Travellers may not post links to other websites on Hideaway Portugal. Any links which are posted will be removed by us. Should Owners wish to send Travellers website links, this can be done in reply to a Traveller enquiry. Links provided by us to third party websites are given purely to help users of our website, and it does not necessarily mean that we agree in full with the content or conditions of these linked websites.

All information published by us on our website is fully copyrighted and protected by law. This includes all texts, ideas, logos, photographs, illustrations, maps, layouts, links and codes. No material can be used, copied, altered, transferred or sold without our prior written authorization. Any breaches of copyright will be dealt with through legal frameworks. All information published by us on our website and in conducting our business reflects our opinions and ideas. These serve as a guide to help Owners and Travellers, and we cannot be held responsible for any inaccuracies given by us. Opinions given by us are subjective and not meant to cause any misunderstanding or harm. We cannot be held responsible for any effects they may have.
REVIEWING AND APPROVING OWNERS, HOLIDAY HOMES AND RELATED SERVICES
We are careful in reviewing Owners and their holiday homes and related services. We are also selective in the ones which we choose to list and approve for our website, rejecting those that we feel do not fit our specialized focus or are in any way inappropriate or not trusted. Once listed, we may also alert approved Owners to information which we think may need improving, be inaccurate or misleading. In very rare cases, if we feel that Owners have purposefully provided damaging, inaccurate or misleading information and photographs, or have acted in any way which does not meet our terms and conditions or which is unfair, fraudulent, unlawful or illegal, we shall be free to immediately inactivate their account and remove part of or the entirety of their property page from our website, with no recourse for a refund. Although this scenario is unlikely to happen to Owners who have been selected and approved for our website, we reserve the right to take this action, in order to defend our reputation, the value of our venue for registered Owners and the rights and best interests of Travellers. We also reserve the right not to offer renewed advertising space to any Owners or holiday homes, for any reasons which we determine.
OWNERS ARE RESPONSIBLE AND LIABLE FOR THE ACCURACY AND AUTHENTICITY OF ALL INFORMATION PUBLISHED ON THEIR HOLIDAY HOME PROPERTY PAGE.
Owners are responsible for completing, providing and publishing accurate information and photographs related to their holiday home and related services. Owners may change and update any details shown within their published property page at any time after it is first published on our website. In some cases, Owners may ask for our guidance in using their Owner account or completing or translating information, and we may give our help or opinion. We may create property pages ourselves, but Owners are still responsible for ensuring that all details are correct. All information published on the Owner’s property page remains the sole responsibility of the Owner. We cannot be held liable for any information, correct or inaccurate, published by us or an Owner.
WE MAY EDIT DETAILS AND CHOOSE THE STYLE AND CONTENT OF INFORMATION
We may create and edit property pages at any stage. This usually happens at the stage of creating a page at the beginning of a subscription, but may also take place at any time afterwards. Owners are usually contacted when we edit a page. Despite us being able to edit pages, Owners remain responsible for the accuracy and style of information and should any changes be required, they should either contact us or make the changes themselves. We may choose not to include property names on property pages. Any information which is deemed undesirable or harmful will be removed by us.
PRICES AND AVAILABILITY OF A HOLIDAY HOME FOR RENT
Each property page has a price and availability chart associated with the Owner’s holiday home. These are useful features and we ask Owners to keep their price and availability charts fully updated, in order to help Travellers. However, Owners are not obliged to do so, and may prefer Travellers to contact them for this information. Price tables and availability charts can be temporarily deactivated, thus not showing on the page. We cannot be held liable or responsible for any inaccuracies on price charts or availability calendars, including dates which may have been mistakenly double-booked by Owners. This responsibility belongs to the Owners. We suggest Travellers double-check prices and availability when contacting Owners and booking their holiday home, and to ask for written confirmation, which states the dates, property reference number and price paid for the holiday home in question.
PAYMENTS AND RE-IMBURSEMENTS BETWEEN OWNERS AND TRAVELLERS
We are a venue only and not a party to any payment transactions between Owners and Travellers. We take no responsibility for or offer any guarantees or insurance related to methods, timings or values of payments, cancellations and re-imbursements, taking place between Owners and Travellers. We reserve the right to, but are under no obligation, to delist any Owner or Traveller from our website, especially if we become aware that they have conducted illegal, unlawful or unfair actions related to receiving or sending payments. We may alert other Owners or Travellers of any illegal or suspected activity, but are under no obligation to do so.
CONDITIONS OF HOLIDAY HOMES AND RELATED SERVICES
We select holiday homes and assess their standards, character, amenities and guest reviews before approval and during their period of listing, in order to include and maintain properties on our website which are suitable. However, we do this on a purely subjective basis and follow our own criteria. We choose holiday homes of greatly varying character and standard, from simple rustic farmhouses and tented accommodation to fully-equipped luxury properties. We do not adhere to any organization or certification body in order to determine which properties may be listed on our website. We function as a source of information and contact point, but we do not manage or represent holiday homes. We cannot be held liable or responsible for or provide any guarantees related to the condition, position, level of safety or amenities of any holiday home. We cannot be held responsible for any problems which may occur before, during or after a stay. However, we do reserve the right to make our own assessments to delist or not renew holiday homes, for any reason. This includes when conditions have been detrimental to Travellers and when we have received repeated or severe complaints about a specific holiday home. We ask Owners to be honest and accurate and as comprehensive as possible when describing their holiday home, to help Travellers decide on whether the property is suitable for them. We ask Travellers to read property pages carefully, to ask Owners all the questions necessary and to make their own judgement when it comes to booking specific holiday homes.
LEGAL REQUIREMENTS FOR HOLIDAY HOMES
As an Owner of a holiday home listed on our website, you agree that you are responsible for complying with any and all laws, rules and regulations that may apply to the property which you are advertising. We assume no responsibility for your non-compliance.
INSURANCE FOR OWNERS AND TRAVELLERS
We do not provide, offer or recommend any specific insurance products or companies for Owners or Travellers. However, we do suggest that Owners take out insurance policies which cover all aspects of renting their property as a holiday home (including but not limited to damage, theft, injury and personal liability). Similarly, we suggest that Travellers use Travel insurance covering all the usual aspects of travel and visiting foreign countries, including but not limited to cancellations, unavailability of accommodation, theft, lost luggage, injury and medical bills. As a venue only, we cannot be held liable for any claims made between Owners and Travellers.
COMMUNICATING WITH REGISTERED OWNERS AND TRAVELLERS
Owners may be contacted (via the webform or the phone number published on their property page), purely by those interested in staying at their holiday home, or for related matters. Contacting Owners (and Travellers) for commercial and marketing purposes is strictly prohibited. We ask Owners and Travellers to immediately inform us if they have been contacted by a third party for commercial, marketing or any other inappropriate reasons. Owners who do not wish to be contacted by telephone can choose not to publish their phone number on the site. Contact details obtained through our website should not be passed on or sold to third parties, unless it is related to staying at a holiday home. We ask Owners and Travellers to treat the personal information and contact details of those with whom they come into contact through the website in a respectful and confidential manner.
LIMITATION OF LIABILITY
We cannot be held liable for any lost profits, lost income or damages resulting from our website, using our website, these terms and conditions, any breach of these terms and conditions, any tools or services that we provide or any opinions that we give. If you are dissatisfied with our website or do not agree with the full content of our terms and conditions, then you must immediately discontinue using our website. As a venue for advertising holiday homes, our liability is limited to the fees you pay to us in the one subscription period prior to the action giving rise to the liability.
We do not guarantee that our website will meet all of your requirements, or be totally error-free, totally virus-free or be functioning on an uninterrupted basis. You acknowledge and agree that we are a venue and that we have no control over and do not guarantee the safety of any transaction between Owners and Travellers, the safety or condition of any rental property or the truth and accuracy of any listing or comment.
CHOICE OF LAW AND FORUM
This agreement shall be governed by and construed in accordance with the laws of England and Wales and be subject to the non-exclusive jurisdiction of the English courts.
